# A decision may take effect before your challenge is heard

A review or appeal may take time while works, compliance obligations or business consequences continue. We assess whether a separate application for a stay, injunction or other interim order is available and justified.

## This page may be relevant if:

- An order or decision threatens immediate interruption to operations
- You are considering proceedings and need to address what happens meanwhile
- A compliance date may arrive before a dispute can be resolved

## What this usually means

- Check whether the particular review or appeal suspends the decision. Many pathways require a separate stay application; filing proceedings alone should not be assumed to stop its operation.
- The court's power and the test for interim relief depend on the proceeding and governing law. A stay or injunction is not guaranteed.
- Interim relief addresses the position while a dispute proceeds. It does not determine the final outcome or remove the need to prepare the underlying case.

## What commonly matters

1. ### The immediate consequence

Explain what will happen, when it will happen and why later relief may be inadequate. Support the account with documents and evidence.

2. ### Safety and competing interests

Identify effects on other people, public safety and the environment. Practical safeguards or a narrower order may matter.

3. ### Conditions and exposure

Assess the proposed terms and any undertaking or security the court may require. An undertaking as to damages can require you to compensate people affected by the interim order. Consider that potential liability separately from the legal costs of the urgent application and underlying dispute.

## How we help

- Assess the available interim remedy and evidence
- Prepare stay or injunction applications where appropriate
- Coordinate urgent steps with the underlying review or appeal
