# Waste approvals and resource recovery

Receiving fill, storing demolition material or processing waste for reuse can raise several approval questions at once. The legal position depends on the material, what will happen to it, where it will go and the permissions for each site. Calling material a resource, or offering it at no cost, does not establish that its receipt or use is lawful.

If you have received a decision or notice, a strict review or appeal period may already be running. Confirm it promptly and do not rely on an online enquiry.

## This page may be relevant if:

- A proposal involves receiving, stockpiling, sorting, treating or disposing of waste
- Excavated or recovered material is to be brought onto land or supplied for reuse
- There is uncertainty about waste classification, sampling or the receiving site's approvals
- A proposed change, transaction or regulator enquiry raises questions about existing waste activities

## What this usually means

- Planning permission and waste regulation answer different questions. The proposed land use must be checked against planning controls and any consent, while the _Protection of the Environment Operations Act 1997_ (NSW) regulates waste activities and pollution. An environment protection licence may also be required. The permitted waste types, activities and quantities need to match the actual operation.
- Waste classification helps identify suitable management and disposal options. It does not, by itself, establish that material can be applied to land or used as fuel. Source information, sampling, test results and the proposed destination must support the particular legal pathway relied on.
- Resource recovery orders and exemptions perform different functions. An order sets requirements for supplying particular recovered waste; an exemption releases its user from specified regulatory requirements if its conditions are met. Their scope, current status and conditions must be checked together. Any necessary development consent and other permissions still need to be addressed.
- A destination must be lawfully able to receive the particular waste. Liability for unlawful transport can extend beyond the transporter to other participants, including the waste owner. A recipient's general assurance is insufficient protection. Records should establish what was moved, its classification and the legal basis for receipt and use.

## What commonly matters

1. ### The material and the proposed activity

Identify the source, composition, contaminants and volumes, and distinguish storage, processing, disposal and reuse. A change in inputs or the quantity held on site may alter the approvals required, even where the business describes its work in the same way.

2. ### Evidence for lawful receipt and reuse

Test the classification report and any resource recovery documents against the material and intended use. Gaps in sampling, traceability or conditions can prevent reliance on an exemption and leave removal or disposal costs unresolved.

3. ### Impacts, conditions and feasibility

Traffic, dust, odour, noise, water management and fire risks may require expert evidence and operational controls. Assessment costs, licence requirements, possible waste levy liability and the risk of refusal or restrictive conditions belong in the budget before commercial commitments are made.

4. ### Contracts and existing compliance questions

Supply, transport and site agreements should address rejected loads, testing, records and responsibility for removal. Contract terms do not displace statutory liability. If waste has already been received or a regulator has contacted you, preserve the records and address any operative notice or deadline.
